Permanent Residency: Family Class Sponsorship
Only a Canadian citizen or PR can sponsor his / her family member for the PR in
Canada. There are strict eligibility conditions and rules to be met for each specific
category of family member.
The Sponsor, who is a citizen, can apply from both inside and outside Canada,
whereas the Permanent resident has to be living inside Canada. The person who is
being sponsored is called the Principal applicant.
The Canadian immigration law is now very strict on fake marriages. In Canada,
marriage is recognized if only it was solemnized by physical presence of both the
partners and is approved by the laws of the country where it took place and also that of
Canada. Hence, proxy marriage is not approved as legal marriage.
The minimum age to become a sponsor is 18 yrs, and the spouse or Common Law
partner must be 18 yrs old to be sponsored.
The list of persons who can be sponsored are:
● Spouse (wife / husband), common law partner, conjugal partner.
● Dependent children (generally be less than 22 yrs or more than 22 yrs in some
conditions)
● Children for adoption
● Parents, grandparents and their dependent children
● Some orphaned relatives who are less than 18 yrs in defined situations.
Some important conditions to be met are:
● Have income proof to support your family and the person being sponsored.
● Sign an undertaking to sponsor.
● Not to have defaulted for a previous undertaking or spousal payments.
● There should be a 5 yr gap period of a sponsorship you made previously.
